What Is Bail And How Does It Work In California?

Bail is money or a bond posted with the court to secure your release pending trial. Under California law, the right to reasonable bail is protected by Article I, Section 12 of the state constitution.

How Bail Is Set

Each county uses a bail schedule with preset amounts for common offenses. At arraignment, your attorney can argue for a reduction, for own-recognizance (OR) release, or for supervised release based on community ties, employment, and lack of flight risk.

Posting Bail

You can post the full amount in cash, use property, or use a bail bondsman who typically charges a 10% non-refundable premium.
