Expungement in California is governed by Penal Code section 1203.4. It allows eligible defendants who have completed probation to withdraw a guilty or no contest plea, enter a not guilty plea, and have the case dismissed.
For most private employers, the dismissed conviction does not have to be disclosed. That single change can be the difference between an offer letter and a rejection.
Who Qualifies
You qualify if you completed probation successfully, are not currently on probation or charged with a new offense, and were not sentenced to state prison for the conviction (with limited exceptions after realignment).
What Expungement Does Not Do
It does not erase the arrest. It does not restore firearm rights on its own. It does not seal the file from law enforcement or the courts. It does not remove sex offender registration obligations.
